Andy Aitken's practice is primarily focused on the protecton and defense of intellectual property.
Andrew C. Aitken has been successfully securing foreign and domestic patents and trademarks for his clients for more than 20 years.
He has litigated dozens of complex patent, copyright and trademark disputes in federal courts throughout the country, including in New York, Florida, New Jersey, California, Georgia, Illinois, Kentucky, Texas, Virginia and Maryland. Andy also has experience in patent appeals, patent reexamination proceedings, trademark oppositions and trademark cancellation proceedings.

Recent Developments
February 2013
After Mr. Aitken filed a Notice of Appeal, the U.S. Trademark Office reconsidered an application directed to a unique bottle shape and allowed the registration.
January 2013
In a patent case pending in the District Court for the District of Maryland, Mr. Aitken reached a settlement and license agreement that allowed his client to continue to offer the accused products.
September 2011
In a patent case pending in the District of Columbia, the court granted defendant's motion to dismiss. Mr. Aitken represented the defendants.
July 27, 2011
In a patent application relating to Solitaire on-line games, the Patent Office's Board of Appeals reversed the Examiner and found all of the pending claims neither anticipated nor obvious in view of the prior art. See Ex parte Halliburton et al; Appeal 2009-010257.
July 20, 2011
In a trade secret case pending before the Eastern Disctrict of Virginia in Richmond, the Court denied the Defendant's motion to dimiss certain claims and has allowed all of Trident's claims to proceed against defendant Advanced Nutrients. The case relates to benefical bacteria that promotes plant growth. Mr. Aitken represents the plaintiff Trident.
June 23, 2011--
The D.C. Court of Appeals denied Bally Gaming, Inc's motion for sanctions against defendants finding Bally's position "wholly without merit." Mr. Aitken represents the defendants and patent owners Betty Ringo and Jack Pearson.
On March 10, 2010 in Ex Parte General Components, Inc. the Board of Patent Appeals reversed the Examiner's final rejection of important claims directed to a fitting used in connection with the transport and delivery of ultrapure fluids. Fittings using this technology are commonly used in the semiconductor industry. See Appeal 2009-007210
On August 5, 2009 the Board of Patent Appeals sided with Mr. Aitken's argument and found the patent examiner had erred in the rejection of all the pending claims covering a client's invention. See Ex Parte Nelson
On August 5, 2009 the Board of Patent Appeals granted Mr. Aitken's petition to consider his client's reply brief in a patent appeal. See Ex parte McGarvey. In this matter, the Examiner and Deputy Commissioner for Patent Examination Policy had taken the position that citations to dictionary definitions were inadmissible "new evidence" in a reply brief. After a long fought battle with the PTO, the Chief Administrative Patent Judge found that the Patent Office had improperly excluded the reply brief.
On March 31, 2009, after a full trial on the merits, the Trademark Trial and Appeal Board granted Mr. Aitken's petition to cancel the RUSSKAYA trademark which was owned by Spirits international, N.V., the owner of the Stoli family of marks. This holding paves the way for Mr. Aitken's client to launch this best selling global vodka brand in the US market.
